Terms of Service

Effective Date: May 1, 2026

These Terms of Service ("Terms") govern your access to and use of the software, websites, and services provided by Melty Face Media LLC ("Melty Face Media", "we", "us", or "our"), including the MeltyBase Sovereign OS platform (collectively, the "Services").

Sovereign Acceptance

By purchasing a license, downloading the source code, or utilizing any portion of the MeltyBase platform, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

1. The License

MeltyBase is a sovereign, self-hosted platform. Upon successful payment of the fees associated with your selected tier (Indie or Commercial), Melty Face Media LLC grants you a perpetual, non-exclusive, non-sublicensable, and non-transferable license to install and use the Software within your own private infrastructure.

1.1 License Tiers

Indie License: Restricted to individual developers or entities with less than $100k in annual revenue. Valid for one (1) production instance.
Commercial License: Required for organizations with revenue exceeding $100k. Includes high-availability deployment rights and priority security audits.

2. Ownership & Intellectual Property

The Software, including but not limited to the Go engine, Studio interface, and documentation, is the intellectual property of Melty Face Media LLC. The Software is licensed, not sold.

While you are granted access to the source code for customization and self-hosting purposes, Melty Face Media LLC retains all rights, title, and interest in and to the original source code, architectural patterns, and brand assets.

3. Prohibited Use Cases

You agree not to, and will not permit any third party to:

Reverse engineer, decompile, or attempt to extract the license verification logic for the purpose of bypassing payment.
Use MeltyBase to provide a competing "Backend-as-a-Service" (BaaS) cloud platform without a specific Enterprise Partnership Agreement.
Redistribute the MeltyBase source code in any public repository or third-party marketplace.
Use the Services for any illegal or unauthorized purpose, including the hosting of malware or illicit data.

4. Non-Refundable Digital Goods

Due to the irrevocable nature of digital source code delivery, all purchases are final and non-refundable. Upon receipt of the download link and license key, the transaction is considered complete and executed. Melty Face Media LLC does not offer "change of mind" refunds.

5. Sovereign Responsibility & Liability

MeltyBase is a self-hosted tool. You acknowledge that Melty Face Media LLC does not host your data, manage your servers, or have access to your encryption keys.

WE PROVIDE THE SOFTWARE "AS IS" AND DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. MELTY FACE MEDIA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING DATA LOSS, SECURITY BREACHES, OR SYSTEM DOWNTIME RESULTING FROM YOUR CONFIGURATION OF THE SERVICES.

6. Support & Maintenance

The perpetual license includes one year of software updates and critical security patches. Continued access to the MeltyBase Update Stream after the first year may require a maintenance subscription.

7. Termination

We reserve the right to revoke your license and terminate your access to the Services (including update streams) if you violate these Terms. Upon termination, you must cease all use of the Software and destroy all copies of the source code in your possession.

8. Governing Law

These Terms shall be governed by the laws of the State in which Melty Face Media LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.
